Storefront Sentry Terms of Service

These Terms form a legally binding agreement between Storefront Sentry and every Shopify merchant who installs or uses the app. Review them carefully before activating Storefront Sentry in your store.

Overview

These Terms of Service ("Terms") constitute a legally binding agreement between Storefront Sentry ("Storefront Sentry," "we," "us," or "our") and every Shopify Merchant ("Merchant," "User," "you," or "your") who installs, accesses, or uses the Storefront Sentry Shopify application (the "App"). By installing or using the App you agree to these Terms. If you do not agree, do not install or use Storefront Sentry.

1. Description of Services

Storefront Sentry provides storefront security, bot mitigation, and checkout validation services for Shopify merchants. The Services may utilize edge computing infrastructure, cryptographic validation mechanisms, traffic analysis, and Shopify-native technologies to assess and enforce traffic rules prior to checkout completion. The Services are designed to assist Merchants in identifying and mitigating high-risk traffic, automated checkout attempts, VPN usage, and other potentially abusive behavior. The Services are a tool and do not replace the Merchant's independent security obligations. We reserve the right to modify, enhance, or discontinue features of the Services at any time.

2. Eligibility and Authority

You represent and warrant that:

  • You are authorized to bind the Shopify store associated with the installation.
  • You will use the App in compliance with all applicable laws and Shopify's platform terms.
  • You are responsible for all activity occurring under your store account.

3. License Grant and Restrictions

3.1 Limited License

Subject to these Terms, Storefront Sentry grants you a limited, non-exclusive, non-transferable, revocable license to use the App solely in connection with your Shopify store.

3.2 Prohibited Conduct

  • Reverse engineer, decompile, disassemble, or attempt to derive source code from the App, including ss-guard.js, Shopify Function logic, or cryptographic validation systems.
  • Circumvent, disable, or interfere with the App's security mechanisms, including the storefront pass system.
  • Modify, copy, create derivative works of, or reproduce any portion of the App.
  • Use the App for unlawful, discriminatory, or rights-violating conduct.
  • Use the App in a manner that could harm the integrity or performance of our infrastructure.

3.3 Ownership

All rights, title, and interest in and to the App and Services, including all intellectual property rights, remain exclusively with Storefront Sentry.

4. Data Processing and Merchant Responsibility

Storefront Sentry acts as a data processor with respect to customer-related data processed through the App and processes such data solely on behalf of and pursuant to instructions from the Merchant. You are solely responsible for:

  • Compliance with applicable privacy, data protection, trade, anti-discrimination, and consumer protection laws.
  • Configuration of traffic rules, blocking policies, country restrictions, or VPN enforcement.
  • Providing any required disclosures to your customers.

The App is a technical enforcement tool; all operational decisions remain the responsibility of the Merchant. Your use of the App is also governed by our Privacy Policy, which is incorporated herein by reference.

5. Third-Party Dependencies

The Services rely on third-party infrastructure, including but not limited to Shopify and Cloudflare. We do not control these providers and are not responsible for service interruptions, data loss, infrastructure outages, API changes, platform modifications, or network failures. Any disruption caused by third-party services is outside our reasonable control.

6. Fees, Billing, and Refunds

6.1 Billing. Fees are billed through Shopify's billing system in accordance with your selected subscription tier.

6.2 Modifications. We reserve the right to modify pricing, subscription tiers, features, or usage limits. Price increases will be communicated at least thirty (30) days in advance where required by Shopify policy.

6.3 Traffic Limits. We may impose request caps, bandwidth throttling, or require plan upgrades for sustained high-volume usage to preserve system stability.

6.4 Refunds. Except as required by law or Shopify policy, fees are non-refundable. Billing disputes must be handled through Shopify's billing platform.

7. Term and Termination

7.1 Termination by Merchant. You may terminate by uninstalling the App through Shopify.

7.2 Termination by Storefront Sentry. We may suspend or terminate access at any time, with or without notice, if you breach these Terms, your usage presents security or infrastructure risk, required by law or platform policy, or if we discontinue the Services.

7.3 Effect of Termination. Upon termination your license ends immediately, access to Services ceases, and data handling will proceed as described in our Privacy Policy. Sections intended to survive termination shall survive.

8. Service Availability and Fail-Safe Design

The App may operate in a fail-open configuration in certain error scenarios to prevent disruption of legitimate customer transactions. No security solution guarantees 100% protection. We do not warrant that all bots or malicious actors will be prevented, and security enforcement may be bypassed or fail under certain conditions.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED AS IS AND AS AVAILABLE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, STOREFRONT SENTRY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE SERVICES WILL PREVENT ALL FRAUD, BOT ACTIVITY, OR MALICIOUS CONDUCT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION, OR REPUTATIONAL HARM; OR FALSE POSITIVES, BLOCKED CUSTOMERS, OR PERCEIVED LOST SALES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO STOREFRONT SENTRY DURING THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold harmless Storefront Sentry and its owners, officers, and operators from any claims, damages, liabilities, costs, or legal fees arising from your misuse of the App, your breach of these Terms, your violation of applicable laws, or your store's configuration decisions.

12. Force Majeure

We shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including natural disasters, acts of government, war or terrorism, internet or infrastructure failures, platform outages, or labor disputes.

13. Modifications to Terms

We may update these Terms from time to time. Continued use of the App after changes become effective constitutes acceptance of the revised Terms. If required by platform policy, we will provide notice of material changes.

14. Dispute Resolution

14.1 Governing Law. These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

14.2 Mandatory Arbitration. Any dispute arising from or relating to these Terms shall be resolved by binding arbitration in Hillsborough County, Florida, in accordance with the rules of the American Arbitration Association.

14.3 Class Action Waiver. You agree to bring claims only in your individual capacity and waive any right to participate in a class or representative proceeding.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Storefront Sentry and supersede any prior agreements or understandings.
